1. Acceptance of Terms
By accessing or using Breathe™, you agree to these Terms of Service and any policies referenced in them. If you do not agree to these terms, you should not use the platform.
2. Eligibility
You must be legally capable of entering into a binding agreement in your jurisdiction to create an account, organize a fundraiser, or otherwise use services that require an account.
If you use Breathe™ on behalf of an organization, business, or other entity, you represent that you have authority to act on its behalf.
3. Accounts
You are responsible for providing accurate information and for keeping your account credentials secure.
You are responsible for activity that occurs through your account. You should notify Breathe™ if you believe your account has been accessed or used without authorization.
4. Fundraisers
Fundraiser organizers are responsible for the accuracy of the information they publish and for clearly explaining the purpose of their fundraiser.
Organizers must use funds in a manner consistent with the representations made to supporters, subject to circumstances that may reasonably require changes.
Breathe™ may request additional information about a fundraiser when necessary for safety, compliance, payment processing, or platform review.
5. Donations and Contributions
Supporters are responsible for deciding whether to contribute to a fundraiser and should review the available information before making a contribution.
Unless specifically stated otherwise, contributions made through Breathe™ should not be assumed to be tax deductible.
Breathe™ does not guarantee that a fundraiser will achieve its goal or that every organizer will use funds exactly as a supporter may expect.
6. Fees and Payment Processing
Breathe™ may charge platform, service, transaction, payment processing, or other disclosed fees in connection with use of the platform.
Any applicable fees should be presented before a transaction is completed whenever required.
Payment processing may be provided by third-party payment providers and may also be subject to their terms, fees, and verification requirements.
7. Prohibited Activity
You may not use Breathe™ for unlawful, fraudulent, deceptive, abusive, or harmful activity.
Prohibited activity may include:
- Providing intentionally false or misleading information.
- Impersonating another person or organization.
- Using funds for unlawful purposes.
- Attempting to manipulate, defraud, or deceive supporters.
- Interfering with the operation or security of the platform.
- Uploading malicious software or harmful code.
- Violating the rights of another person or organization.
- Using Breathe™ in violation of applicable law.
8. User Content
You retain ownership of content you submit to Breathe™, including fundraiser stories, photographs, videos, updates, and other materials you have the right to use.
By submitting content, you grant Breathe™ a non-exclusive license to host, display, reproduce, format, and distribute that content as reasonably necessary to operate, promote, and improve the platform.
You are responsible for ensuring that content you submit does not violate another person's intellectual property, privacy, publicity, or other legal rights.
9. Review, Suspension, and Removal
Breathe™ may review, restrict, suspend, or remove accounts, fundraisers, transactions, or content when we reasonably believe there may be fraud, policy violations, safety concerns, legal concerns, payment disputes, or other misuse of the platform.
In some circumstances, Breathe™ may request additional information before restoring access or releasing funds.
10. Third-Party Services
Breathe™ may rely on third-party providers for services such as payment processing, hosting, identity verification, analytics, or communications.
Those services may be governed by separate terms and privacy policies. Breathe™ is not responsible for third-party services that are outside our control.
11. Disclaimers
Breathe™ provides a platform that helps organizers and supporters connect. Breathe™ is not the organizer, beneficiary, financial advisor, tax advisor, legal advisor, or guarantor of any individual fundraiser unless expressly stated otherwise.
The platform is provided on an "as available" basis to the extent permitted by law. We do not guarantee uninterrupted operation, specific fundraising results, or the accuracy of every statement made by platform users.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Breathe™ and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the platform.
Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to every user.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Breathe™ and its affiliates from claims, damages, liabilities, losses, and expenses arising from your misuse of the platform, violation of these Terms, or violation of another party's rights.
14. Termination
You may stop using Breathe™ at any time.
Breathe™ may suspend or terminate access to the platform when reasonably necessary to enforce these Terms, protect users, comply with legal obligations, prevent fraud, or protect the integrity of the service.
15. Changes to These Terms
Breathe™ may update these Terms from time to time as the platform, laws, or business practices change.
When material changes are made, the updated date at the top of this page will be revised. Continued use of Breathe™ after updated Terms become effective may constitute acceptance of those changes where permitted by law.
